These are the rules for using Deadworks and renting a server from us. We have written them to be readable rather than exhaustive. If anything is unclear, ask us on Discord.
1. Acceptance
These terms are an agreement between you and Deadworks. By using deadworks.net, the public server browser, the Deadworks launcher, or Deadworks Hosting, you agree to them. If you do not agree, please do not use our services. Our Privacy Policy explains how we handle your information and forms part of these terms.
2. Eligibility
You must be at least 13 years old to use Deadworks, or at least 16 where local law requires it, and at least 18 to rent a server or otherwise pay us. If you use Deadworks on behalf of a team or organisation, you confirm you have the authority to accept these terms for them.
3. Accounts and security
A hosting account is created when you sign in for the first time. You are responsible for keeping your sign-in method secure, whether that is your email inbox or a sign-in provider such as Google, and for everything done through your account. Tell us straight away if you think someone else has access to it. Each account is for one person; do not share it.
4. Deadworks Hosting
Deadworks Hosting lets you rent a dedicated Deadlock server running the Deadworks framework. When you create a server you choose the amount of memory and the region it runs in. The price is shown before you pay and is billed as a monthly subscription. You can change memory later, which changes the price from the next billing cycle or immediately on a pro-rated basis as shown at the time.
Servers are provisioned on machines run by our infrastructure providers. Provisioning usually completes within minutes but it can fail, for example when a region is out of capacity. If a server cannot be provisioned, we will either get it running or refund the payment for it in full. We will tell you which on the server's page in the portal.
You control the server through the portal: starting, stopping, restarting, changing settings, viewing the console, and managing files. Some files are managed by the platform and cannot be edited. Server addresses are allocated when the server is created and may change if the server is rebuilt.
5. Billing
- Payments are handled by Stripe. We never see your card details. By paying you also agree to Stripe's terms.
- Subscriptions are monthly, in advance. Each server is its own subscription and renews automatically until you cancel it.
- Tax is calculated at checkout based on your billing address and added where it applies.
- Cancel any time from the billing portal. Your server keeps running until the end of the period you have paid for, then it is stopped and, after a short grace period, deleted.
- Refunds. We do not refund partial months when you cancel. We do refund in full when we cannot provision a server, and we may refund at our discretion in other cases. Ask us on Discord.
- Failed payments. If a renewal payment fails, Stripe retries it. If it keeps failing, your server is suspended and then deleted after the grace period.
- Price changes apply from your next renewal and we will tell you in advance.
6. Acceptable use
Use Deadworks the way a decent person would. Specifically, you must not:
- Host, share, or distribute anything illegal, or anything that infringes someone else's rights.
- Use rented servers to run cheating tools, exploits, or anything that breaks Valve's or Deadlock's terms or interferes with other players' games.
- Harass, threaten, or abuse other players or members of the community.
- Attack, probe, or overload our infrastructure, our providers' infrastructure, or anyone else's. Do not use a server as a launching point for attacks, scanning, spam, or crypto-mining.
- Deliberately trigger or abuse the DDoS protection in front of your server, or try to get around resource limits.
- Resell or sublet a rented server without telling us first.
- Use automated tools to scrape the server browser at a rate that affects other users.
7. Your content
You own what you put on your server: configuration, maps, plugins, and any other files. You are responsible for it, including making sure you have the right to use it and that it complies with the law and these terms. We do not monitor server content routinely, but we may look at it if we receive a complaint or suspect abuse, and we may remove content or suspend a server if we need to. You give us the limited permission we need to store, transfer, and run your content in order to provide the service.
Keep your own backups. We do not currently offer backups of rented servers, and we are not responsible for lost files.
8. Suspension and termination
We may suspend or delete a server, or close an account, if a payment is overdue, if these terms are broken, if we are required to by law, or if a server is harming the service or other users. Where we reasonably can, we will warn you first and give you a chance to fix the problem. You can close your account at any time by cancelling your subscriptions and asking us to delete it.
9. Service availability
Deadworks Hosting is in early access. We work hard to keep servers up, but we do not guarantee any particular level of uptime and there is no service credit for downtime. We may take servers offline for maintenance, usually with notice. Game updates from Valve can require servers to restart or be rebuilt, sometimes at short notice. Our infrastructure providers may also experience outages we cannot control.
10. Intellectual property
The Deadworks framework is open source and published on GitHub under the MIT License. You can use it under that licence independently of these terms. The Deadworks name, logo, website, hosting portal, and documentation belong to Deadworks and may not be copied or used to suggest an affiliation without our permission.
Deadlock is a trademark of Valve Corporation. Deadworks is an independent community project and is not affiliated with or endorsed by Valve.
11. Third-party services
Parts of Deadworks rely on other companies: WorkOS for sign-in, Stripe for payments, Google if you sign in with it, our infrastructure providers for the machines servers run on, and Discord and GitHub for the community. Their terms apply to your use of their services, and we are not responsible for them.
12. Disclaimer and limitation of liability
In plain English: we provide Deadworks as it is, without promises that it will be error-free, uninterrupted, or fit for a particular purpose, and to the extent the law allows we exclude all warranties that would otherwise apply.
To the extent the law allows, Deadworks is not liable for indirect or consequential losses, lost data, lost profits, or losses caused by things outside our control, including our infrastructure providers, game updates, or attacks on our services. Our total liability to you for anything arising from these terms or the services is limited to the amount you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
13. Changes to these terms
We may update these terms as the services evolve. We will change the date at the top and, for changes that materially affect hosting customers, tell you by email or through the portal before they take effect. Continuing to use Deadworks after a change means you accept the updated terms.
